1. Acceptance of Terms By accessing or using Stemographer (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and subscribers. 2. Description of Service Stemographer is a native plant gardening tracking application that allows users to record, organize, and analyze data about their native plant collections, gardens, growing methods, and materials. The Service is designed for personal, non-commercial gardening use. 3. Accounts and Registration To access the full features of Stemographer, you must create an account. You agree to: Provide accurate and complete information when creating your account. Maintain the security of your password and accept responsibility for all activity under your account. Notify us immediately of any unauthorized use of your account. You must be at least 13 years of age to use this Service. 4. Subscription Plans and Billing Stemographer offers paid subscription plans: Seedling Plan: Includes 1 Collection, 1 Garden, up to 10 Plant Species, and basic analytics. Perennial Plan: Includes unlimited Collections, Gardens, Plant Species, and advanced analytics. Subscriptions are billed monthly and processed securely through Stripe. You may cancel your subscription at any time through your account's Subscription settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months of service. 5. User Content You retain full ownership of all data, plant records, journal entries, photos, and other content you create within Stemographer ("User Content"). By using the Service, you grant us a limited license to store and display your User Content solely for the purpose of providing the Service to you. You are responsible for ensuring your User Content does not violate any applicable laws or third-party rights. 6. Acceptable Use You agree not to use the Service to: Violate any applicable local, state, national, or international law. Attempt to gain unauthorized access to any part of the Service or its related systems. Transmit any harmful, offensive, or disruptive content. Use the Service for any commercial purpose without our prior written consent. 7. Plan Limits Users on the Seedling plan are subject to the usage limits of that plan (1 Collection, 1 Garden, up to 10 Plant Species). We reserve the right to enforce these limits to ensure fair access to the Service. If you exceed your plan's limits, you will be prompted to upgrade to the Perennial plan. 8. Disclaimer of Warranties The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Stemographer is a gardening tracking tool and does not provide professional horticultural, botanical, or agricultural advice. 9. Limitation of Liability To the fullest extent permitted by law, Stemographer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the three months preceding the claim. 10. Account Termination You may close your account at any time by contacting us. Upon termination, your data will be permanently deleted. We reserve the right to suspend or terminate accounts that violate these Terms of Service. 11. Changes to Terms We may update these Terms of Service from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms. We will update the date at the top of this page when changes are made. 12.
